    All assets must be disclosed in a divorce. Failure to disclose assets may result in a divorce being re-opened and re-litigated to the detriment of the non-disclosing Party.

    In Washington State, full and honest disclosure of assets in a divorce is crucial for a fair and equitable division of property and to avoid legal repercussions.  Washington is a community property state, meaning assets acquired during the marriage are generally split equally. Failure to disclose can lead to serious penalties, including redistribution of assets, financial penalties, and even criminal charges. 

    • Fair Division of Assets: Washington law requires a just and equitable distribution of marital assets. Full disclosure ensures both parties have a complete understanding of the marital estate, enabling a fair division. 
    • Avoiding Legal Consequences: Intentionally hiding assets is considered fraudulent and can lead to severe penalties. These penalties can include:
      • Redistribution of Property:  The court can award a larger share of the assets to the spouse who was honest, or even award the entire undisclosed asset to them, according to divorce attorneys. 
      • Financial Penalties: The dishonest spouse may be ordered to pay the other spouse’s attorney’s fees and costs associated with uncovering the hidden assets. 
      • Contempt of Court: Failing to comply with court orders regarding financial disclosure can result in contempt of court charges, potentially leading to fines or even jail time. 
      • Criminal Charges: In extreme cases, hiding assets can be considered fraud, potentially leading to perjury or fraud charges. 
    • Impact on Spousal and Child Support: Hidden assets can affect calculations for spousal and child support, potentially leading to unfavorable outcomes for the spouse who hid assets. 
    • Damage to Credibility: Financial dishonesty can significantly damage a spouse’s credibility in the eyes of the court, potentially impacting decisions related to child custody and spousal support. 

    In essence, full disclosure ensures transparency and fairness in the divorce process, protecting both parties and upholding the integrity of the legal system. It prevents one spouse from gaining an unfair advantage through deception and helps ensure that assets are divided in a just and equitable manner.

    I am an experienced solo estate planning, debtor bankruptcy, and real estate attorney. At my law firm in Bellevue, Washington between Eastgate and Factoria, I do things a little differently. I am passionate about helping people take control of their lives.
